Please read these terms and conditions carefully before making your booking. By making a booking with us, you agree to be legally bound by these terms and conditions. If you do not wish to be bound by these terms and conditions then regrettably you may not make a booking via our website.
If you do not comprehend any of the contract conditions, we strongly recommend that you contact Customer Service before proceeding with any booking. If any provision or term of these terms and conditions shall become or be declared illegal, invalid or unenforceable for any reason whatsoever, such term or provision shall be deleted but all other terms will remain valid.
1 Service and Contract Formation
1.1 ExecuSmart is the trading name of Smart Intentions Ltd and is an Executive transport service provider. The contract for the provision of the transportation service is between you and Smart Intentions Ltd.
1.2 By booking a service from our website, you are entering into a contract with Smart Intentions Ltd. You agree to be legally bound by these terms and conditions when you make a reservation.
1.3 When you submit your request for service, your reservation details our system and only when the request is accepted your reservation is confirmed and a confirmation email is sent to you. At this point the contract between you and Smart Intentions Ltd is formed.
2.1 The liability for the provision of transfer services between you and Smart Intentions Ltd is restricted solely to those two parties between whom the service has been contracted. Smart Intentions Ltd liabilities resulting from this agreement shall therefore be limited between you and the Smart Intentions Ltd. Any liabilities resulting from the provision of the transfer service shall be the sole responsibility of the Smart Intentions Ltd and their insurance companies.
2.2 Smart Intentions Ltd reserves the right to pass the transportation service to an affiliate driver. All affiliate drivers are fully licensed and insured.
2.3 Neither we nor any affiliate will be responsible for any losses you suffer (including for example any missed flights) due to your failure to allow sufficient time for your journey.
2.4 In agreeing to the terms and conditions you accept that Smart Intentions Ltd will in no way be held responsible for any losses, expenses or claims made by you in the event of any problem associated with any part of your travel plan other than that as identified by the transfer service booking.
3 Availability of Service
3.1 We are entitled to refuse any order placed by you. We do not guarantee to successfully allocate a service for every booking request. In the event that we are unable to accept your booking request we will send an email to advise you.
3.2 All information is given on our website is in good faith and is believed to be correct at the time. Smart Intentions Ltd will not be responsible for any inaccuracies due to out of date information. We will do our best to keep this information up to date.
3.3 Vehicle model and type indicated in the on our website are for description of the type of service. In rare cases we may need to arrange a replacement vehicle should this be necessary in order to provide the transportation service. For example, in the case that the vehicle booked is delayed in traffic. A suitable and equivalent replacement will be provided. We do not guarantee that the exact model or type of vehicle specified in your confirmation email will be used for the service.
4.1 The default payment method is payment with booking, unless otherwise agreed. If you fail to cancel your reservation in accordance with our cancellation policy a cancellation or no-show fee will be charged.
4.2 Advance payment is required during the booking. Smart Intentions Ltd use PayPal to facilitate the payment process. A PayPal account is not a requirement and PayPal provide the payment by credit or debit card facility.
4.3 You confirm that all details you provide to us for the purpose of making the booking a service are correct, that the credit or debit card which you use is your own.
5.1 There is no cancellation fee charged for cancellations provided that you cancel a minimum of 24-hours before the booked transfer pick-up time.
5.2 General reservation cancellation policy
a) 12 to 24 hours before booked time the fee is 20% of cost of the booking cost.
b) 6 to 12 hours before booked time the fee is 40% of cost of booking cost.
c) 6-hours or less before the booked time the fee is 100% of the booking cost.
5.3 Waiting period
a) pick-up from airports: 60 minutes from the flight actual arrival time.
b) pick-up from any other point: 15 minutes from the agreed pick-up time.
5.4 In case of no show without communication, after the waiting period has ended (see clause 5.3 above) the full cost of the booked service will be charged.
5.5 Any changes to your reservation must be sent to us in writing via e-mail 24-hours prior to the date of travel. All changes to your reservation must be made directly with Smart Intentions Ltd.
5.6 We will advise you as soon as possible to the e-mail address you have given us if for any reason your booking has to be cancelled.
6 Child seats
As per the EU directive 2003/20/EC the following applies:
6.1 Children must use the correct child seat until they are 135cm tall or age 12 (whichever they reach first). They then must wear an adult seat belt. It is the driver’s responsibility to see that children are restrained correctly. However, there is an exemption for licensed vehicles, which can still carry children even if the correct child seat is not available.
6.2 Children under 3 years of age, with or without child seat, still count towards the vehicle occupancy.
7 Excess luggage
7.1 Please inform us at the time of booking if you wish to travel with excess baggage. Please note the number of cases the selected vehicle type can carry at the time of booking. This is to ensure our vehicle can accommodate you. The passenger (you) shall be liable for all expenses incurred should additional vehicles be required to transport non-declared excess luggage. We will not try to accommodate more luggage than is defined for the vehicle type.
8 Force Majeure
8.1 Smart Intentions Ltd cannot be held liable for delays, changes or cancellation of service due to force majeure, or to other circumstances that are unforeseeable or beyond the service provider control, such as accidents suffered by third parties on the transfer route, police checkpoints, acts of terrorism, extreme weather conditions etc.
9 Intellectual Property Rights
9.1 Copyrights, trademarks and other intellectual property rights of the website have been granted under license to Smart Intentions Ltd and are protected by national and international regulations governing intellectual property.
9.2 Use of our website content by third parties for any purpose other than booking transfers is prohibited, including the modification, subsequent publication and total or partial reproduction or representation of the same without the express consent of Smart Intentions Ltd.
